Pursuant to the Virginia Voluntary Remediation Regulations, Virginia Administrative Code section 9VAC20-160-120, Linden PropCo, LLC (the Owner, a Virginia Limited Liability Company with a Principal Office at 30 North Michigan Avenue, Suite 2100, Chicago,, Illinois 60602), hereby provides notice of voluntary remediation at the following site:

The Site comprises approximately 22.70 acres of undeveloped land, formerly the Frederick County Middle School. The site was an orchard prior to the development of the middle school in 1966 and the building was subsequently removed by the current landowner. Site investigation studies indicated the presence of elevated arsenic, and some lead, in the shallow soils across the site associated with the historic orchard use. The Participant applied to and was deemed eligible to participate in the Virginia Voluntary Remediation Program (VRP) in order to assess and address any environmental
risks associated with the impacted soil. A Site Characterization Report, Soil Management Plan, Health and Safety Plan and Remedial Action Plan have been submitted, reviewed and accepted as complete by DEQ. The remediation will include stripping the top layer of soil across the site and properly disposing of the shallow soils offsite. The soil will be transported to approved disposal sites in accordance with Virginia regulations. These efforts will be documented and summarized in the Demonstration of Completion report. Given the complete removal of the contaminated soil from the property, the Owner will request a Certification of Satisfactory Completion of Remediation (Certificate) from DEQ through VRP with no deed restrictions on this property.
