The Solid Waste Management Regulations require permits prior to construction, operation, or modification of a solid waste management facility. This includes facilities that store, treat, dispose or otherwise manage solid wastes. Under these regulations, permits are required for solid waste disposal facilities, including sanitary landfills, construction/demolition/debris landfills, industrial waste landfills, coal combustion residual landfills and surface impoundments.
Permits are also required for solid waste treatment or storage facilities, transfer stations, composting facilities, waste to energy and incineration facilities, materials recovery facilities, waste storage piles and other facilities of a similar nature, unless the activity is exempt from permitting requirements.
The Transportation of Solid and Medical Wastes on State Waters (also referred to as the Barge Regulations) require permits for any receiving facility that off-loads solid waste or regulated medical waste transported upon the navigable waters of the Commonwealth by a commercial transporter. Loading facilities and vessels transporting solid wastes or regulated medical wastes on navigable waters do not require permits; however, must comply with requirements for facilities and vessels outlined in the regulations.
