Final Stage:
The State Air Pollution Control Board voted to adopt the proposed regulation repeal at its June 7, 2023 meeting.  The final regulation repeal was published in the Virginia Register on July 31, 2023.

Although the rulemaking became effective August 30, 2023, 9VAC5-140-6445 provides that the rule is fully repealed as of December 31, 2023, and that affected facilities must meet their remaining compliance obligations no later than March 1, 2024. These compliance obligations have been met, and the program is now fully completed.

Proposed Stage:
proposed regulation was published on January 30, 2023, and the public comment period was open through March 31, 2023.
