Solid and Hazardous Waste Permits

How to Comment and/or Request a Public Hearing for Permit Actions

DEQ accepts comments and requests for public hearing by e-mail, or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/requester and of all persons represented by the commenter/requester.  

A request for public hearing must also include: 

  1. The reason why a public hearing is requested.  
  2. A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requestor, including how and to what extent such interest would be directly and adversely affected by the permit.  
  3. Specific references, where possible, to terms and conditions of the permit with suggested revisions. DEQ may hold a public hearing, including another comment period, if public response is significant and there are substantial, disputed issues relevant to the proposed permit.

The public may request documents, information or review the draft permit and application by contacting the permit writer directly.

Corrective Action Plans for Underground Storage Tanks

For each confirmed release that requires a corrective action plan (CAP), the owner/operator is required to provide notice to reach members of the public directly affected by the release or the planned corrective action.

Site release information and decisions concerning the CAP are available to the public for inspection upon request by contacting the DEQ case manager directly. The DEQ regional office will consider written comment for 30 days following CAP submittal and may decide to hold a public meeting if there is significant public interest.

Superfund and Federal Facilities

Comments on proposed remediation projects may be sent directly to the contact listed in the notice. DEQ does not receive the comments directly or hold public meetings on these types of projects.

Resource Conservation and Recovery Act (RCRA) Corrective Action Proposed Remedy Decisions

Before DEQ makes a final decision on a proposed remedy for a Corrective Action Facility, the public may participate in the decision process by reviewing this Statement of Basis (SB) and documents contained in the Administrative Record (AR) for the Facility. The AR contains all information considered by DEQ in reaching this proposed decision. Interested parties are encouraged to review the AR and comment on DEQ’s proposed decision. The public comment period will last thirty (30) calendar days from the date the notice is published in a local newspaper unless additional time is specified in the SB. Comments may be submitted by mail, or e-mail, to the contact listed in the SB.
